为做好《中华人民共和国出境入境管理法》和《外国人入境出境管理条例》等法律法规的贯彻实施工作,进一步规范外国人在中国就业行为,人力资源社会保障部、外交部、公安部、文化部联合制定了《外国人入境完成短期工作任务的相关办理程序(试行)》(以下简称《办理程序》)。现印发给你们,请认真执行。
In order to implement the law of the people's Republic of China on the administration of exit and entry and the regulations on the administration of entry and exit of foreigners and other laws and regulations, and further standardize the employment behavior of foreigners in China, the Ministry of human resources and social security, the Ministry of foreign affairs, the Ministry of public security and the Ministry of culture jointly formulated the relevant handling procedures for foreigners to complete short-term work tasks (for Trial Implementation) (hereinafter referred to as the handling procedures). It is hereby printed and distributed to you, please implement it carefully.
各级人力资源社会保障、外事、公安、文化等部门应按照《办理程序》为入境完成短期工作任务的外国人办理相关手续。对于未按《办理程序》办理相关手续入境及不按工作证明所列事项从事短期工作的外国人,公安机关将按非法就业查处。各部门要逐步完善各项管理制度,加强协调配合,强化信息沟通,为入境完成短期工作任务的外国人提供便利。
Human resources, social security, foreign affairs, public security, culture and other departments at all levels shall go through relevant formalities for foreigners who enter the country to complete short-term work tasks in accordance with the handling procedures. For foreigners who fail to go through relevant formalities for entry in accordance with the handling procedures and engage in short-term work according to the matters listed in the work certificate, the public security organ will investigate and deal with them as illegal employment. All departments should gradually improve various management systems, strengthen coordination and cooperation, strengthen information communication, and provide convenience for foreigners entering the country to complete short-term tasks.
《办理程序》自 2015年1月1日起执行。请各部门抓紧做好执行前的各项准备工作。外国人在中国短期工作证明(中英文)和外国人短期工作信息表、外国人演出信息表电子模板另行发放。
The handling procedures shall be implemented as of January 1, 2015. All departments are requested to make preparations before implementation. The certificate of foreigners' short-term work in China (in Chinese and English), the electronic template of foreigners' short-term work information form and foreigners' performance information form will be issued separately.

Relevant handling procedures for foreigners entering the country to complete short-term work tasks (for Trial Implementation)
一、外国人入境完成短期工作任务,指因下列事由入境,且在境内停留不超过90日的(需办理工作证)Foreigners entering the country to complete short-term work tasks refer to those who enter the country for the following reasons and stay in the country for no more than 90 days (work permit required):
(一)到境内合作方完成某项技术、科研、管理、指导等工作Complete a certain technology, scientific research, management, guidance and other work with domestic partners;
(二)到境内体育机构进行试训(包括教练员、运动员)Conduct trial training in domestic sports institutions (including coaches and athletes);
(三)拍摄影片(包括广告片、纪录片)Shooting films (including advertising films and documentaries);
(四)时装表演(包括车模、拍摄平面广告等)Fashion Show (including car models, shooting print advertisements, etc.);
(五)从事涉外营业性演出Engaged in foreign-related commercial performances;
(六)人力资源社会保障部门认定的其他情形Other circumstances recognized by the human resources and social security department。
二、以下情形不视为完成短期工作任务(无需办理工作证)The following situations are not considered as the completion of short-term work tasks(work permit not required):
(一)购买机器设备配套维修、安装、调试、拆卸、指导和培训的Purchase of machinery and equipment supporting maintenance, installation, commissioning, disassembly, guidance and training;
(二)对在境内中标项目进行指导、监督、检查的Guiding, supervising and inspecting the winning projects in China;
(三)派往境内分公司、子公司、代表处完成短期工作的Dispatched to domestic branches, subsidiaries and representative offices to complete short-term work;
(四)参加体育赛事的(包括运动员、教练员、队医、助理等相关人员。但根据国际体育组织要求,经我国主管部门批准,持注册卡入境参赛等情况除外)Those who participate in sports events (including athletes, coaches, team doctors, assistants and other relevant personnel, except those who enter the country with a registration card after being approved by the competent authorities of China according to the requirements of international sports organizations);
(五)入境从事无报酬工作或由境外机构提供报酬的义工和志愿者等Volunteers and volunteers engaged in unpaid work or paid by overseas institutions;
(六)文化主管部门在批准文书上未注明“涉外营业性演出”的The competent cultural department does not indicate "foreign-related commercial performances" on the approval document。
具有(一)(二)(三)(四)情形,且停留时间不超过90日的,应当申请办理M字签证;具有(五)(六)情形,且停留时间不超过90日的,应当申请办理F字签证。In case of (1) (2) (3) (4) and the stay time does not exceed 90 days, it shall apply for M visa; In case of (5) or (6), and the stay time is not more than 90 days, they shall apply for F visa.
三、前述第一条、第二条第(一)、(二)、(三)、(五)项所列人员每次入境停留时间超过90日的,均应按照《外国人在中国就业管理规定》申请办理相关手续。入境从事季节性劳务、短期劳务按有关规定执行。
四、入境进行短期营业性演出的外国文艺表演团体、个人应持有文化主管部门出具的批准文书及在中国短期工作证明(以下简称工作证明);入境完成其他短期工作任务的,应持有人力资源社会保障部门颁发的外国人就业许可证书(以下简称许可证书)及工作证明。 Any person listed in items (1), (2), (3) and (5) of Article 1 and Article 2 who stays in China for more than 90 days each time shall apply for relevant formalities in accordance with the provisions on the administration of employment of foreigners in China. Seasonal labor services and short-term labor services in China shall be implemented in accordance with relevant regulations.
工作证明登记项目包括:持有人国籍和姓名、工作内容、工作地点、工作期限、签发日期等。The registration items of work certificate include: nationality and name of the holder, work content, work place, work period, issuance date, etc.
五、短期工作人员申请入境工作应按下列程序办理Short term workers shall apply for entry according to the following procedures:
(一)申请工作许可Apply for work permit
1申请人力资源社会保障部门许可证书及工作证明Apply for the license and work certificate of human resources and social security department
境内合作方拟邀请外国人入境从事短期工作的,应向省级人力资源社会保障部门或者其授权的地市级人力资源社会保障部门提出申请,并提交以下证明材料If a domestic partner intends to invite foreigners to enter the country for short-term work, it shall apply to the provincial human resources and social security department or its authorized Prefecture and municipal human resources and social security department, and submit the following supporting materials:
(1)境内合作方登记证明、组织机构代码(均为复印件)Registration certificate and organization code of domestic partners (all copies);
(2)中外双方合作协议、项目合同等Sino foreign cooperation agreement, project contract, etc;
(3)拟入境人员简历Resume of foreigner to entry;
(4)有效护照或其他国际旅行证件(复印件)Valid passport or other international travel documents (copy);
(5)申请完成专业技术工作任务的外国人,应按国家规定提供相关学历或技术(职业)资格证明文件Foreigners applying to complete professional and technical tasks shall provide relevant academic or technical (vocational) qualification certificates in accordance with national regulations;
(6)审批机关规定的其他证明材料Other supporting materials specified by the examination and approval authority。
人力资源社会保障部门对入境短期工作事由明确、完整、合理,且没有违反国家法律法规者,发放许可证书及工作证明。The human resources and social security department shall issue a permit and work certificate to those who have clear, complete and reasonable reasons for entry short-term work and do not violate national laws and regulations
外国人入境完成工作任务的地点涉及两个或以上省级地区的,应在境内合作方所在地的人力资源社会保障部门申请办理相关手续。If the place where the foreigners enter the country to complete their tasks involves two or more provincial regions, they shall apply for relevant formalities at the human resources and Social Security Department of the place where the domestic partner is located.
各省级人力资源社会保障部门应在外国人入境前,将《外国人短期工作信息表》,以电子文档形式报送人力资源社会保障部。All provincial human resources and social security departments shall submit the short-term work information form of foreigners to the Ministry of human resources and social security in the form of electronic documents before foreigners enter the country.
2申请文化主管部门批准文书及工作证明Application for approval documents and work certificates from competent cultural authorities
外国文艺表演团体、个人拟入境进行营业性演出的,应当由演出举办单位向首次演出所在地文化主管部门提出申请,文化主管部门应当根据《营业性演出管理条例》及其实施细则的规定,自受理申请之日起20日内作出决定。批准的,发给批准文书,并注明“涉外营业性演出”;不予批准的,应当书面通知申请人并说明理由。其中,拟入境进行营业性演出的外国文艺表演团体、个人,在境内停留时间不超过90日的,文化主管部门为其出具工作证明。演出增加地已列入工作证明的,演出增加地文化主管部门不再另行出具工作证明。If a foreign artistic performance group or individual intends to enter the country for commercial performance, the performance organizer shall submit an application to the competent cultural department of the place where the first performance is located. The competent cultural department shall make a decision within 20 days from the date of accepting the application in accordance with the regulations on the Administration of commercial performance and its detailed rules for implementation. If it is approved, an instrument of approval shall be issued, indicating "foreign-related commercial performances"; If the application is not approved, it shall notify the applicant in writing and explain the reasons. Among them, the competent cultural department shall issue a work certificate for foreign artistic performance groups and individuals who intend to enter the country for commercial performances if they stay in China for no more than 90 days. If the place where the performance is added has been listed in the work certificate, the competent cultural department of the place where the performance is added shall not issue a separate work certificate.
演出所在地文化主管部门应在外国文艺表演团体、个人入境前,将《外国人演出信息表》通过涉外营业性演出审批信息公示系统报送文化部,文化部以电子文档形式抄送人力资源社会保障部。Prior to the entry of foreign artistic performance groups and individuals, the competent cultural department of the place where the performance is located shall submit the foreigner performance information form to the Ministry of culture through the information publicity system for the approval of foreign-related commercial performances, and the Ministry of culture shall copy it to the Ministry of human resources and social security in the form of electronic documents.
入境进行营业性演出的外国文艺表演团体、个人,完成短期工作任务后,拟继续在境内进行短期营业性演出的,演出举办单位应重新向文化主管部门申请工作证明,但工作时间不超过停留或居留许可有效期。审批手续依照本程序中“申请文化主管部门批准文书及工作证明”的有关要求办理。If a foreign artistic performance group or individual entering the country for commercial performances intends to continue to perform short-term commercial performances in China after completing short-term work tasks, the performance organizer shall re-apply to the competent department of culture for work certificate, but the working period shall not exceed the validity period of stay or residence permit. The approval procedures shall be handled in accordance with the relevant requirements of "application for approval documents and work certificates from the competent cultural department" in these procedures.
(二)办理邀请函或邀请确认函Apply PU Letter or invitation confirmation
用人单位持许可证书及工作证明到注册地或所属被授权单位申请办理邀请函或邀请确认函。The employer shall apply for the PU letter or invitation confirmation letter at the place of registration or its authorized unit with the permit certificate and work certificate.
演出举办单位持批准文书及工作证明到注册地或首次演出所在地省、自治区、直辖市政府外事部门,办理被授权单位邀请确认函。The performance organizer shall present the approval document and work certificate to the Foreign Affairs Department of the government of the province, autonomous region or municipality directly under the central government where the performance is registered or where the first performance is located to handle the invitation confirmation letter of the authorized unit.
(三)申请Z字签证Apply for Z visa
获准入境完成短期工作任务的外国人,应到中国驻外使馆、领馆或者外交部委托的其他驻外机关(以下简称驻外签证机关)申请Z字签证。申请人应提供以下证明材料Foreigners who are allowed to enter China to complete short-term work tasks shall apply for Z-visa at Chinese embassies, consulates or other agencies abroad entrusted by the Ministry of Foreign Affairs (hereinafter referred to as visa agencies abroad). The applicant shall provide the following supporting materials:
(1)许可证书(批准文书)和工作证明的原件及复印件Original and copy of permit (approval document) and work certificate;
(2)被授权单位邀请函或邀请确认函PU letter or invitation confirmation letter of authorized unit;
(3)本人护照或者其他国际旅行证件的原件和复印件The original and copy of my passport or other international travel documents;
(4)驻外签证机关要求的其他材料Other materials required by the visa authority stationed abroad。
驻外签证机关对许可证书(批准文书)原件和工作证明原件进行核验,留存复印件。对于工作证明中工作期限不超过30日的,驻外签证机关均签发停留期为30日的签证,同时在备注栏做双语备注“工作时间不得超出工作证明所注期限 Allowed to work only within the period of time indicated in the approval ”;对于工作证明中工作期限超过30日的,签证备注栏中应注明入境后30日内办理居留手续。The visa authority stationed abroad shall verify the original of the permit certificate (approval document) and the original of the work certificate, and keep a copy. For those whose working period in the work certificate does not exceed 30 days, the visa authorities stationed abroad shall issue visas with a residence period of 30 days, and make bilingual remarks in the remarks column: "working hours shall not exceed the period indicated in the work certificate. Allowed to work only within the period of time indicated in the approval ”; If the working period in the work certificate exceeds 30 days, it shall be indicated in the remarks column of the visa that the residence formalities shall be handled within 30 days after entry.
与中国有互免签证协议国家人员,入境完成短期工作任务的,需在入境前获得工作证明,并持上述材料到我国驻外签证机关申请Z字签证。Personnel from countries with mutual visa exemption agreements with China who enter the country to complete short-term work tasks shall obtain a work certificate before entering the country and apply for Z visa at China's visa authorities abroad with the above materials.
(四)办理工作类居留证件Apply for work residence certificate
工作期限不超过30日的短期工作人员,按工作证明上注明的工作期限工作,并在Z字签证中注明的停留期停留。工作期限超过30日的短期工作人员,按工作证明上注明的工作期限工作,并持工作证明、Z字签证等证明材料到公安机关办理停留期为90日的工作类居留证件。其中,外国文艺表演团体、个人可持工作证明和Z字签证等证明材料到演出举办单位注册地或首次演出所在地公安机关办理居留手续。已取得居留证件的外国演员在国内其他演出地演出,不再重复办理居留手续。Short term staff with a working period of no more than 30 days shall work according to the working period indicated on the work certificate and stay within the stay period indicated in the Z-visa. Short term staff with a working period of more than 30 days shall work according to the working period indicated on the work certificate, and go to the public security organ to apply for a work residence certificate with a residence period of 90 days with work certificate, Z-visa and other supporting materials. Among them, foreign artistic performance groups and individuals can go through residence formalities with the public security organ at the place where the performance organizer is registered or where the first performance is located on the strength of work certificates, Z-visa and other supporting materials. Foreign actors who have obtained residence certificates to perform in other places in China will not repeat the residence procedures.
六、其他事项Other matters
(一)获得批准文书和工作证明的外国人取消工作任务未入境的,演出举办单位应及时函告文化主管部门;获得许可证书和工作证明的外国人取消工作任务未入境的,境内合作方应及时函告人力资源社会保障部门审批机关。If a foreigner who has obtained the approval document and work certificate cancels his work task and does not enter the country, the performance Organizer shall promptly notify the competent department of culture by letter; If a foreigner who has obtained a permit certificate and work certificate cancels his work task and does not enter the country, the domestic partner shall promptly notify the examination and approval authority of the human resources and social security department by letter.
(二)外国人入境完成短期工作任务,其工作期限不得超出工作证明所注期限,工作证明到期后不延期。When foreigners enter the country to complete short-term work tasks, their work period shall not exceed the period specified in the work certificate, and the work certificate shall not be extended after expiration.
持工作证明的外国人完成短期工作任务后,若其居留许可在有效期内,拟被境内用人单位聘用的,可按《外国人在中国就业管理规定》的有关程序在境内办理相关手续。After completing short-term work tasks, foreigners with work certificates who intend to be employed by domestic employers within the validity period of their residence permit may go through relevant formalities in China in accordance with the relevant procedures of the provisions on the administration of foreigners' employment in China.
