Foreign experts who meet the Category A standards of the Foreign Experts Administration may apply for the work permit directly in China by holding any valid visa. The required materials shall be submitted in a complete set following the criteria of a new application. Family members of Category A foreign talent shall apply for residence permits together directly with valid visas after obtaining the Class A work permit.
Conditions
Common scenario: Monthly salary meets 35,390 RMB and above, or points meet above 85 in the point-scoring system.
Steps
a. Company registers its account in the Foreign Experts Bureau’s system (if account is already registered, this step can be skipped) – 3 working days.
b. Submit a complete set of materials according to the criteria of a new work permit – 5+5 working days.
c. Foreign talent and his/her family members apply for the residence permit together – 15 working days.
If the spouse or a child of a Chinese citizen; or the spouse or a child of a foreigner permanently residing or working in China holds a valid visa or residence permit, he or she may apply for a work permit according to the corresponding criteria. The required materials are based on the criteria of a complete set of a new application, including the valid documents, visa and authentication of the relationship with the Chinese citizen or permanent resident.
Conditions:
Spouse or a child of a Chinese citizen or a foreigner who permanently resides of works in China, or a child (18 years or older) with a valid visa or residence permit holding a valid and legal relationship certificate (foreign documents need to be notarized and authenticated).
Steps:
a. Company registers its account in the Foreign Experts Bureau’s system – 3 working days.
b. Submit a complete set of materials according to the criteria of a new work permit and family members’ certificates and relationship certification – 5+10 working days (Category A: 5+5).
c. Apply for residence permit – 15 working days.
On the premise that the original work residence permit is valid and the criteria of the foreign talent’s work permit transfer is satisfied, foreign talent can apply for a new work permit directly in China after cancelling the original work permit. Required materials for the application include the complete set of information in accordance to the criteria of a new application, with the exception of the non-criminal certificate.
Conditions:
a. Residence permit under current job must be valid and cannot be cancelled.
b. If the nature of the company that foreign talent is reappointed to is similar to that of the previous company, similar positions can be transferred.
c. The original work permit must be cancelled or expired.
Steps:
d. Cancel the original work permit – 5+5 working days.
e. Register of new company account – 3 working days.
f. Submit materials according to the criteria of job reappointment/transfer (non-criminal certificate not required) – 5+10 working days (Category A: 5+5).
g. Apply for residence permit after obtaining new work permit .
Representatives of representative office may apply for a new work permit according to the criteria of a new work permit application, after cancelling their current work permit, and before their current work residence permit expire. Required materials for the application include the complete set of materials according to the new application criteria.
Conditions:
a. Residence permit under current job must be valid and cannot be cancelled.
b. Only unidirectional (representative office to a general company, not the other way around) change is valid.
c. Original work permit must be cancelled or expired.
d. Apply for residence permit after obtaining new work permit.
Steps:
a. Cancel the original work permit – 5+5 working days.
b. Register of new company account – 3 working days.
c. Submit materials according to the criteria of job reappointment/transfer (non-criminal certificate not required) – 5+10 working days (Category A: 5+5).
d. Apply for residence permit after obtaining new work permit .
